3. Subject of this Privacy Policy
This privacy policy informs you which personal data we process when you use the website www.ela-gebrauchtcontainer.de, for what purposes, on what legal basis, and what rights you are entitled to.
4. Processing When Visiting the Website (Server Log Files)
When you access the website, our web server or hosting provider automatically processes data transmitted by your browser:
- IP address (usually shortened/temporary)
- Date and time of access
- Page/file accessed
- Referrer URL
- Browser type/version
- Operating system
- Provider/device information (where technically necessary).
Purposes: Provision of the website, IT security, stability, error analysis and prevention of misuse.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in a secure and functional website).
Storage period: Log data is generally only stored for as long as necessary for the stated purposes; it is then deleted or anonymised, unless statutory retention obligations or security-related requirements prevent this.
5. Contact and Inquiries
If you contact us via forms, email or telephone, we process the data you provide (e.g. name, contact details, company information, content of your inquiry and, where applicable, attachments/photos).
Purposes: Processing your inquiry, preparing offers, pre-contractual measures and, where applicable, contract performance.
Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures/contract) or – if there is no (pre-)contractual relationship – Art. 6(1)(f) GDPR (legitimate interest in processing inquiries).
Necessity: Without providing the information marked as mandatory fields, we generally cannot process your inquiry.
Storage period: We delete the data after processing has been completed, unless it is still required for contract fulfilment or statutory retention obligations exist (e.g. commercial and tax law). In these cases, data is blocked and deleted once the retention periods have expired.
6. Recipients and Categories of Recipients
We only transfer personal data insofar as this is necessary for the stated purposes. Possible recipients are:
- IT and hosting service providers (operation, maintenance, support)
- Service providers for content/file delivery (CDN)
- Consent management providers
- Tag and advertising services (only with consent)
- Authorities/public bodies, where we are legally obliged to do so.
Involvement of Other Group Companies:
If the inquiry relates to the activities of subsidiaries, affiliated companies or agency companies of ELA Container, and this is necessary for efficient processing of the inquiry, your data may be forwarded to the relevant company. These may include the following companies: ELA Container Nederland BV, ELA Container Polska Sp. z o. o., ELA Container Sales GmbH, ELA Container Participaties BV, UAB ELA Container Lietuva, ELA Container Offshore GmbH, ELA Container Projects BV, ELA Container Belgium BV, ELA Container Offshore USA Corp., ELA Container UK Ltd., ELA Container Engineering GmbH, ELA Container Austria GmbH, ELA Container Real Estate BV, ELA Container Offshore Holding GmbH, ELA Container CZ s.r.o., ELA Container Denmark ApS, ELA Container Production GmbH, ELA Container Switzerland GmbH.
The legal basis for this is Art. 6(1)(f) GDPR in conjunction with Recital 48, as we have a legitimate interest in the transfer for internal administrative purposes.
Insofar as service providers act as processors, this is done on the basis of Art. 28 GDPR (data processing agreement).
7. Transfers to Third Countries
When integrating services from international providers, data may be transferred to third countries (outside the EU/EEA, e.g. the USA).
In these cases, transfers only take place if the requirements of Art. 44 et seq. GDPR are met, in particular through adequacy decisions (e.g. the EU–US Data Privacy Framework, where applicable) or appropriate safeguards (e.g. EU standard contractual clauses) as well as, where applicable, supplementary protective measures.
Note: In third countries, a level of data protection comparable to that in the EU cannot be guaranteed; government access cannot be completely ruled out.
8. Cookies and Similar Technologies
We use cookies and similar technologies (e.g. local storage, tags) to provide the website and – with your consent – to enable marketing/conversion measurement.
We use technically necessary cookies/technologies on the basis of § 25(2) TTDSG. We only use non-necessary cookies/technologies (e.g. marketing) with your consent (§ 25(1) TTDSG in conjunction with Art. 6(1)(a) GDPR).
You can change your consent at any time via the "Cookie Settings" in the website footer or revoke it with effect for the future. Revocation does not affect the lawfulness of processing carried out up to that point.
